Terms of Service

By accessing or using the Service, or by installing the BessieAI script on your website, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use the Service.
If you are using the Service on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.
BessieAI is a structured charter request capture and qualification system for aviation brokers and operators (the “Service”). It collects inbound request details through a guided interface, validates and normalizes inputs, and generates a structured request summary for delivery to the Customer.
BessieAI is not a broker or operator, does not arrange travel, and does not guarantee lead quality, conversion, pricing, availability, or booking outcomes. Email and messaging are delivery channels, not the product.
- “Customer”: the broker or operator subscribing to and using the Service.
- “End User”: an individual submitting a charter request via the Customer’s website.
- “Allowed Domain”: the website domain approved for use with the Customer’s subscription.
- “Request Data”: information submitted by End Users and processed by the Service.
You must be at least 18 years old and have authority to bind the Customer to these Terms. You may use the Service only for lawful commercial purposes related to charter operations.
- Each subscription is tied to an Allowed Domain.
- You are responsible for securing management links, credentials, and inbox access.
- You may not resell, sublicense, or provide access to the Service to third parties without written permission.
We may suspend or restrict access if we detect unauthorized domain use, abuse, or violations of these Terms.
You are solely responsible for:
- Compliance with applicable laws and regulations (including aviation, consumer, marketing, and data protection laws).
- Your communications, quotes, pricing, contractual terms, and any relationship with End Users.
- Reviewing request summaries before acting on them.
Request Data is user-submitted and may be incomplete, inaccurate, or misleading. If a detail cannot be provided, the Service may mark it as TBD.
For charter Request Data submitted through the Customer’s website, the Customer is the data controller and BessieAI acts as a data processor. For Customer account and website usage data, BessieAI acts as a data controller.
Customers may request a Data Processing Addendum (DPA) governing BessieAI’s processing of Request Data.
You agree not to:
- Use the Service for spam, phishing, deception, or unlawful activity.
- Interfere with the security, availability, or normal operation of the Service.
- Attempt to bypass domain restrictions, authorization controls, rate limits, or other safeguards.
- Upload or transmit malware or harmful code.
Violations may result in suspension or termination.
The Service is provided as-is and as-available. We do not guarantee uninterrupted availability, delivery within a specific time frame, or compatibility with all browsers, devices, or third-party systems.
We may modify, update, or discontinue features of the Service. We will use commercially reasonable efforts to provide notice of material changes.
Payments and subscription charges are processed by Lemon Squeezy, which acts as the Merchant of Record. Lemon Squeezy may issue invoices/receipts, collect VAT or other applicable taxes, and process payment methods.
Subscriptions are billed in advance on a monthly or annual basis (as selected) and renew automatically unless canceled.
You may cancel at any time. Access will remain active until the end of the current paid period.
Refunds are not provided for unused time except where required by law or as expressly provided by Lemon Squeezy’s checkout terms.
Failed payments may result in suspension or termination.
BessieAI and its licensors retain all rights, title, and interest in the Service, software, and related materials. You retain ownership of your business data and the Request Data you receive from End Users.
You may not copy, modify, reverse engineer, or create derivative works of the Service except to the extent permitted by law.
Each party may receive non-public information about the other party. Each party agrees to use reasonable care to protect the other party’s confidential information and to use it only to perform under these Terms.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and accuracy of user-provided information. You use the Service at your own risk.
To the maximum extent permitted by law:
- BessieAI will not be liable for lost profits, lost revenue, lost business opportunities, loss of goodwill, or indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim will not exceed the amount you paid for the Service in the three (3) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations; in that case, liability is limited to the maximum extent permitted by law.
You agree to indemnify and hold BessieAI harmless from claims, damages, liabilities, and expenses arising from:
- Your use of the Service;
- Your dealings with End Users;
- Your violation of applicable laws or regulations; or
- Content you submit or instruct the Service to process.
We may suspend or terminate access if you breach these Terms, fail to pay, misuse the Service, or if required by law.
Upon termination, your access to the Service will end. Sections that by their nature should survive (including IP, disclaimers, limitation of liability, indemnification, and governing law) will survive.
These Terms constitute the entire agreement between you and BessieAI regarding the Service and supersede all prior or contemporaneous agreements, proposals, communications, or understandings, whether written or oral, relating to the Service.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
You may not assign or transfer these Terms without prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
These Terms are governed by the laws of Belgium, without regard to conflict-of-law principles. Disputes shall be resolved in the competent courts of Belgium.
We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
